The present “General Terms and Conditions of Sale” apply to legal transactions relating to products marketed to its customers by Com’On Dress within its online store.
The following words or expressions shall have the following meanings:
Internet Store: dmeans the Com’On Dress website on which Products are displayed and sold to customers.
Order: means the contract of sale between and the customer of the Internet Shop and Com’On Dress.
Product sheet: means the classified information concerning a product provided by Com’On Dress when the product is put on sale in its web shop.
Products: means all the goods and services offered for sale by Com’On Dress in its internet shop.
Service: means the sale of Products by Com’On Dress to the customers of its internet shop.
Transaction : refers to all transactions, secure processing, authorizations and agreements relating to the payment of the price of products ordered by credit card.
ARTICLE 1 – OBJECT
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which Com’On Dress offers and sells its Products to its customers.
These general conditions of sale will prevail over all other conditions appearing in any other document, except preliminary, express and written exemption.
ARTICLE 2 – ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing an Order, these terms and conditions of sale and expressly accept them without reservation.
The present general conditions of sale govern the contractual relations between Com’On Dress and his client, the two parts accepting them without reserve.
ARTICLE 3 – PRODUCTS
The majority of products offered by Com’On Dress to its customers are immediately available.
However, some products marketed by Com’On Dress may have a manufacturing time, they will be indicated to customers when ordering.
ARTICLE 4 – ORDER
Automatic registration systems are considered to be proof of the nature, content and date of the Order.
Com’On Dress will confirm to the customer the acceptance of his Order by sending a confirmation message to the email address that he has communicated. The sale will not be concluded until the sending of the order confirmation.
Com’On Dress reserves the right to refuse or cancel any Order from a customer, in particular in case of insolvency of said customer or in the event of a failure to pay the Order concerned or a previous delivery or a dispute over the payment of a previous order.
The particulars indicated by the customer, when entering information pertaining to his Order, bind him. Com’On Dress can not be held responsible for errors committed by the customer in the wording of the addressee of the Order (delivery address, billing address in particular) and delays in delivery or inability to deliver the Products ordered that these errors could engender.
ARTICLE 5 – DELIVERY
After confirmation of the Order and subject to payment of the price of the products ordered, the creators working with Com’On Dress commits to send to his client the products ordered to the delivery address within 5 to 10 days except exception (ex: order for abroad)
All Products stipulated in the Orders placed at are for the personal use of the customers or recipients whose name is mentioned at the delivery address.
In this case, the customer agrees to settle upon receipt, all taxes, duties, taxes and other charges present and future due for the delivery of said products themselves; joint and several liability can not be committed at any time.
The customers or the recipients of the Products are prohibited any partial or total resale of the Products.
Delivery will be made by an authorized company at our convenience.
In case of late delivery exceeding twenty (20) days, the Customer may, if he wishes, and except in cases of force majeure, denounce the sales contract by registered letter with acknowledgment of receipt. This right must, however, be exercised within thirty (30) working days from the date of delivery initially provided for in the contract.
In the event that one or more of the Products ordered are missing or damaged, the customer or the recipient must make any reservations with the carrier at the time of delivery.
In case of apparent defects, the customer has the right of return under the conditions provided in the instructions for use of the property.
For reasons of availability of the Products ordered, an Order may be the subject of several successive deliveries to the customer.
In the event that the customer would like the Products ordered to be delivered to twodifferent addresses, it will be necessary for the latter to pass 2 separate Orders.
ARTICLE 6 – RETRACTATION
The customer has a period of 40 days days from receipt of the Products ordered to return to Com’On Dress for exchange or refund. In this case, the customer will have to return the new products, intact, accompanied by all possible accessories, instructions and documentation to the address on the package.
In case of exercise of the right of withdrawal, Com’On Dress undertakes to reimburse the sums paid by the customer, free of charge, with the exception of the costs of return.
The refund is due within a maximum of 40 days.
ARTICLE 7 – PRICES
The price is expressed in euro.
The price indicated on the Product Sheets does not include the costs inherent to the transport.
The price indicated in the order confirmation is the definitive price, all taxes included and including VAT. This price includes the price of the Products, the costs of handling, packaging and storage of the Products, transport costs and commissioning.
ARTICLE 8 – PAYMENT
The price charged to the customer is the price indicated on the order confirmation sent by Com’On Dress.
The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the actual order.
The Order validated by the customer will only be considered effective when the secure bank payment center has given its agreement on the transaction and, if applicable, after acceptance of the assumption of risk by the insurer.
ARTICLE 9 – APPLICABLE LAW
These general conditions of sale are subject to French law
ARTICLE 10 – LIABILITY
Com’On Dress can not be held responsible for damage of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the Products marketed.
The responsibility of Com’On Dress will, in any case, be limited to the amount of the order. In case of difficulties in the application of this contract, the customer and reserve the possibility, before any action in court, to seek an amicable solution.
Otherwise, for business customers, the Commercial Court of Créteil has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
ARTICLE 11 – GUARANTEE
In any case can not be held responsible for non-compliance with regulations and laws in force in the country of receipt. The responsibility of Com’On Dress is systematically limited to the value of the Product in question determined at the date of its sale and this without recourse to the brand or the company producing the product. /p>

ARTICLES 12 – LEGAL INFORMATIONS
The information of the personal information collected for the purposes of the distance selling is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The lack of information leads to the non-validation of the Order.
In accordance with the law “Informatique et Libertés”, the processing of personal information relating to customers has been declared to the Commission Nationale Informatique et Libertés (CNIL).
The customer has (Article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with Com’On Dress. In addition, Com’On Dress undertakes not to communicate, free of charge or in return, the details of its customers to a third party.
